Terms of use

These terms are between MBOS (“we”, “us”) and the organisation whose people use the MBOS Communications Portal (“you”). If you accept these terms on behalf of an organisation, you confirm that you are allowed to do so.

The portal lets you send survey invitations by SMS, collect answers, and hand out rewards up to a limit you set. You stay in control of who is contacted, what is asked, and what rewards are promised.

We are a processor of the personal information you load; you remain the responsible party (controller) for it.

You may only load contact details you are lawfully allowed to use, and you must be able to show the lawful basis for contacting each person.

Every survey invitation must identify your organisation and give people a way to opt out. You may not use the portal for unsolicited marketing.

You must keep sign-in details private, use one account per person, and remove people from your workspace when they leave.

You may invite more people than the number of rewards you promise, this is normal when recruiting. Rewards go to the first people to finish, up to the limit you set, and everyone else may still take part. The rule and the order are recorded for each completion so it can be checked afterwards.

Reward limits are enforced by the system: never more than the number you promise will be handed out, even when many people finish at once.

SMS charges are shown before you send and recorded against each message. You are responsible for the cost of messages sent from your workspace.

We aim to keep the portal available at all times but cannot promise uninterrupted service. Planned maintenance is announced in the portal where practical.

Neither party is liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by South African law.

You may stop using the portal at any time. On request we will delete or return the personal information in your workspace, except where the law requires us to keep records.

These terms are governed by the laws of South Africa. We will try to resolve any dispute in good faith before turning to the courts.
